What Happens if You Do Not Show Up to Immigration Court

If you have an immigration court date in the United States, attending is absolutely critical. Failing to appear—often referred to as missing immigration court—can have severe consequences for your immigration future. Many people don’t realize that even one missed hearing can lead to an automatic deportation order without another chance to defend themselves.

What Is an “In Absentia” Removal Order?

When you miss your immigration court hearing, the judge will likely issue an in absentia removal order. This means you are ordered deported in your absence, without presenting your case or any defense. The court assumes you have abandoned your case, whether you were seeking asylum, adjustment of status, or any other relief.

Serious Consequences of Missing Court

Missing immigration court can:

  • Result in deportation without another hearing.
  • Block future immigration benefits, sometimes permanently.
  • Make relief options like asylum, cancellation of removal, or voluntary departure unavailable.
  • Allow ICE to detain you at any time and carry out removal.

Depending on your case, you could face a re-entry bar of 5 years or more—and in some situations, a permanent ban from the United States.

Can You Reopen the Case?

There is no direct appeal for an in absentia removal order. However, you may file a motion to reopen within 180 days if you can prove one of these:

  • You did not receive proper notice of your hearing.
  • Exceptional circumstances prevented you from attending, such as a serious medical emergency.

These motions are difficult to win, and the longer you wait, the less likely you are to succeed. Immediate legal help is essential.

Don’t Ignore a Missed Hearing

If you realize you missed immigration court, act immediately. Contact an experienced immigration attorney to review your options and possibly file to reopen your case before it’s too late.
