A Step-by-Step Guide to the Adjustment of Status Process

Adjustment of Status (AOS) allows eligible individuals already in the United States to apply for lawful permanent resident status, commonly known as a Green Card, without needing to return to their home country. This guide will walk you through the key steps of the AOS process.

Step 1: Determine Your Eligibility

Before applying for Adjustment of Status, it’s crucial to ensure you meet the eligibility requirements. Generally, you must have entered the U.S. legally and be eligible for a Green Card through a family member, employer, or other recognized categories. Understanding your eligibility is the first step toward a successful application.

Step 2: Gather Required Documents

Once you confirm your eligibility, it’s time to gather the necessary documents. Commonly required documents include your passport, birth certificate, proof of lawful entry into the U.S., and any supporting documentation relevant to your Green Card category (like Form I-130 or Form I-140). It’s essential to have everything organized to avoid delays in the process.

Step 3: Complete Form I-485

The next step is to complete Form I-485, the Application to Register Permanent Residence or Adjust Status. This form is critical for your AOS application. Ensure you fill it out completely and accurately, as any mistakes can lead to delays or even denial. You may also need to submit additional forms, depending on your circumstances.

Step 4: Submit Your Application

After completing Form I-485, you can submit your application package to the appropriate USCIS office. Be sure to include all required documents and the filing fee. It’s a good practice to keep copies of everything you send.

Step 5: Attend the Biometrics Appointment

Once your application is processed, you will receive a notice for a biometrics appointment. During this appointment, your fingerprints, photo, and signature will be taken. This information is used for background checks, so it’s important to attend this appointment.

Step 6: Attend the Interview

In most cases, USCIS will schedule an interview to discuss your Adjustment of Status application. This is your chance to explain your case in person. Prepare by reviewing your application and any documents you submitted. Bring any additional evidence that supports your application.

Step 7: Wait for the Decision

After your interview, you will receive a decision on your Adjustment of Status application. If approved, you will receive your Green Card in the mail. If denied, USCIS will provide the reasons for denial, and you may have the option to appeal the decision.
